PIP Insurance in Florida: What It Covers and When It's Not Enough

Blog Highlights

  • Florida PIP insurance helps pay certain medical expenses and lost income after a crash, regardless of who caused it.
  • Benefits are limited, and initial medical care must begin within 14 days.
  • Serious or permanent injuries may create options for pursuing compensation beyond PIP.

Florida PIP insurance is meant to provide quick financial support after a motor vehicle accident. Personal injury protection in Florida can cover part of your early medical bills and lost income, but PIP coverage is not designed to cover every loss. Understanding Florida car accident insurance laws can help you recognize when additional action may be needed. These limits can become especially important when treatment continues for weeks or injuries prevent a return to work.

What Does Florida PIP Insurance Cover?

Florida law generally requires registered vehicle owners to maintain PIP coverage. Standard benefits include up to $10,000 for medical and disability expenses, with PIP paying 80 percent of reasonable medical costs and 60 percent of qualifying lost income. Initial medical care must occur within 14 days of the crash. A $5,000 death benefit may also apply.

Why PIP Coverage May Fall Short

Even when the full benefit is available, PIP leaves important gaps. It does not cover the remaining share of medical bills, all lost income, vehicle damage, or the full effect of a serious injury. Benefits may also be limited to $2,500 when a qualified provider determines that the injured person did not have an emergency medical condition.

When Can You Seek Compensation Beyond PIP?

Additional claims may be possible when another party caused the accident, and available insurance applies. Florida law also allows certain damages for injuries involving a significant and permanent loss of bodily function, a permanent injury, significant and permanent scarring or disfigurement, or death.
